It is Gifting Queen's policy to respect your privacy regarding any information we may collect from you across our website, http://www.GiftingQueen.com, and other sites we own and operate. We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used. We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification. We don’t share any personally identifying information publicly or with third-parties, except when required to by law. Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies. You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services. Your continued use of our website will be regarded as acceptance of our practices around privacy and personal information. Under data protection law, it is considered a "legitimate business interest" to use our customers’ details for direct marketing purposes.  With your permission and/or where permitted by law, we may also use your personal data for marketing purposes, which may include contacting you by email with information which we think you might find interesting, news, and offers on our products or services. These emails will be periodical, and namely based around key gifting occasions throughout the year such as Christmas.  We promise never to bombard you.  You will not be sent any unlawful marketing or spam.  Your details will NEVER be shared with third parties.

We will always work to fully protect your rights and comply with our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003.

 

How long we keep personal data

We will not keep your personal data for any longer than is necessary, or up to a maximum of 6 years.  It will be kept securely, and deleted upon request.

 

Why do we collect your data?

We collect information about you so that we can personalise your use of our website, help your use of our website, and improve your shopping experience, whilst marketing to you more effectively.  You may amend your subscription preferences at any time by logging in to your account and amending your preferences, or contacting us and requesting that we do this on your behalf.

To fulfil your order, you must provide me with certain information (which you authorised GiftingQueen.com or third-party services to provide to me), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (such as the name, age, delivery address of the recipient etc required for custom gifts) if you contact me directly.

These may include but are not limited to, for example, Parcel2Go, Royal Mail, and MyHermes courier services.

CUSTOMER PHOTOGRAPHS: All photographs provided by you (the customer) will only be used for dispute resolution and advertising purposes and shared via our social media platforms and/or used on our websites (GiftingQueen.com or third-party services) with your permission, unless for the use in dispute resolution.

 

DATA RETENTION
I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, resolve disputes, and enforce my agreements. I generally keep your data for no longer than 4 years.

 

TRANSFERS OF PERSONAL INFORMATION OUTSIDE THE EU 
I may store and process your information through third-party hosting services in the USA and other jurisdictions. This will include foreign-owned and operated sites. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

ACCESS: You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
CHANGE, RESTRICT, DELETE: You may also have the right to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
OBJECT: You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
COMPLAIN: If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

 

THIRD-PARTY PAYMENT SERVICES PROVIDERS
We may use third-party payment services providers (such as companies that process payments and disburse settlements, perform risk assessments or compliance checks, verify identity, or validate payment or settlement methods), and we may process your data and transfer it to these third parties. You hereby explicitly consent to: our use of such third-party service providers, the outsourcing of services to them, and the related transfer and processing of data. Where applicable so we can provide you with Managed Payments, you hereby waive any professional secrecy rights. Regardless of whether we use third-party service providers, the appropriate eBay Payment Entity remains responsible to you for the performance of the services contemplated under these Payments Terms of Use. If you have purchased a Gifting Queen Ltd. item through a third party, they will have their own terms for the processing of your order and the associated funds. Please contact them directly for payment information and disputes.
